AMENDMENT TO ZONING BY-LAW (REZONING) 

  • The Township Zoning By-law regulates the use of land, buildings and structures and the general use of property. It also protects environmentally and ecologically sensitive lands, natural heritage features and lands impacted by development. After reviewing the Zoning for your property, if the use, building or structure you are proposing is not permitted on your property, you will require a zoning by-law amendment.

AMENDMENT TO THE OFFICIAL PLAN (OPA)

  •  The County of Elgin is the Approval Authority for local municipal Official Plans and Official Plan  Amendments.  Applications for local municipal Official Plan Amendments are submitted to the local municipality and if adopted by the local municipal Council, the Official Plan Amendment is forwarded to the County for a decision.  In the course of preparing the Official Plan and/or Amendment the local municipality is required to consult with the Approval Authority in accordance with Section 17 (15) of the Planning Act.

LAND SEVERANCE (CONSENT)

  • A land severance is the authorized separation of a piece of land to form a new lot or a new parcel of land. This is commonly known as a consent. Applications for consent are received and processed by the County of Elgin’s Land Division Committee.  All meetings are open to the public and if you wish to attend a meeting, please reference the current agenda for the start time of the meeting. The Township of Malahide may submit comments on consent applications.  The Consent process is administered by the Secretary-Treasurer of the land division committee who coordinates the application and facilitates the processing of approvals through various agencies and individuals. 
  • Fees submitted with application to Land Division Committee.  Subject to fees and deposits if conditions set in order to grant severance.

MINOR VARIANCE

  • A minor variance is a change or permission from the zoning regulations of the Municipality's Zoning By-law. The minor variance process allows a property owner the opportunity to seek permission or relief from a specific zoning regulation of the Municipality's Zoning By-law by applying to the Committee of Adjustment.

SITE PLAN AGREEMENT

  • Site plan control is a tool that is used by the Township to ensure land development is designed appropriately, safe, functional and minimizes potential impacts on neighbouring properties. Site plans provide detailed information about development plans for a specific property. 

  • The Planning Act requires mandatory consultation for all Site Plan Applications. Applicants are encouraged to meet with the Township prior to initiating mandatory consultation to discuss the concept for the site plan and potential considerations or challenges for the site, and to review the submission requirements for consultation. 
  • Site Plan approvals are regulated by Section 41 of the Ontario Planning Act. The approval process ensures development of new properties is safe, efficient, and in accordance with our policies and regulations.
